DOG BITE LAWSUITS: “ONE BITE RULE” AND STRICT LIABILITY

Generally, to recover for injuries sustained in a dog bite accident in New York, the injured must prove that the dog’s owner knew the dog had vicious propensity. Such evidence may include previous incidents of the dog biting someone or being known to growl and snarl at passersby. The requirement to prove a previous vicious propensity is often referred to as the “one bite rule” meaning that the owner may only be held liable if he knew that his dog had a propensity to bite.

Additionally, New York imposes strict liability for medical costs arising out of a dog bite if the bite was from a “dangerous dog.” This holds the defendant liable regardless of whether the dog’s owner took reasonable care to prevent the bite from happening. Note, this strict liability standard only applies to medical costs. Therefore, to recover for other injury-related damages (i.e., lost wages, pain and suffering) the injured must prove a dangerous propensity as described above.
