NO FAULT INSURNACE IN ROCHESTER, NEW YORK

WHAT IS NO-FAULT INSURANCE?

New York State is a “no-fault” insurance state. No-fault insurance is also commonly referred to by insurance companies as personal injury protection (“PIP”).

So, what is no-fault insurance? No-fault insurance means exactly what its named. If you’ve been involved in a car accident in New York State no-fault insurance covers costs associated with the car accident regardless of who was at-fault in the accident. In addition to the resources on this page, New York State’s Department of Financial Services provides a helpful consumer FAQ that you find here that goes into more detail about no-fault insurance if you are curious.  You can also find the text of the regulation here.

If you’ve been injured in a car accident, please contact us by giving us a call at (585) 888-8000 or submit our online form today. Every time I came into the office I have always felt welcome and that's not the case in every law firm. Will recommend to anyone in need of a lawyer.

From my first phone call to the resolution, everyone was very helpful, responsive, kind and efficient in helping me with my injury case. The pandemic certainly slowed everything down, however I was confident that the firm would keep me informed and guide me every step. They certainly are a personal law firm, and I appreciated all the personal phone calls to keep me updated during the entire time. I saw and spoke directly with the attorneys, Al Parisi, Samantha Parisi and Tim Bellavia. I really appreciated all the work, time and effort they put in on my behalf and I would certainly highly recommend Parisi & Bellavia Law Firm.

WHAT EXPENSES DOES NO-FAULT INSURANCE COVER?

WHO DO I FILE MY NO-FAULT INSURANCE CLAIM WITH?

Who to file your no-fault insurance claim with depends on what role you played in the accident. If you were in a vehicle involved in the accident, no matter whether you were the driver or just a passenger in the vehicle, you should file your no-fault insurance claim with the insurance company of the vehicle you were in. If you were a pedestrian and you were struck by a vehicle, you would file your no-fault claim with the vehicle that struck you. If you have any questions, again, you can always reach out to us at (585) 888-8000 to discuss for free.

HOW MUCH TIME DO I HAVE AFTER AN ACCIDENT OCCURS TO FILE A NO-FAULT CLAIM?

30 days, unless the injured person submits written proof with a clear and reasonable justification for the failure to comply with the time limit. This is a fast deadline and insurance companies lobbied for this quick timeline to give them a route to deny more claims, (insurance companies don’t make money by paying out on claims). Of all the things an injured party has to deal with when they’re injured in a car accident, submitting a no-fault insurance claim may not cross your mind immediately. Again, another reason, why it’s so important that you give us a call at (585) 888-8000 as soon as possible when you’ve been injured in a car accident

WHAT DO I DO IF MY COSTS EXCEED $50,000?

$50,000 in no-fault insurance is not a significant amount of money if you’ve suffered a serious injury in a car accident in Rochester. Once you account for medical expenses and lost wages, $50,000 in expenses can rack up quickly.

Assisting Rochester’s injured with car accidents that result in serious injuries is what we do every day, and have done for over 25 year, at Parisi and Bellavia. If you give us a call at (585) 888-8000 we can assess whether to bring a lawsuit against the at-fault party in the accident to help you recover for your lasting injuries.

DOES NO-FAULT APPLY TO MOTORCYCLE ACCIDENTS?

WHY IS IT IMPORTANT TO CONTACT A ROCHESTER CAR ACCIDENT LAW FIRM LIKE PARISI AND BELLAVIA IF I’M INJURED?

As Attorney Al Parisi explains in the above video, you must be careful when filling out your no-fault application, even if your submitting your no-fault application to your own insurance company. Contrary to what you may think, your insurance company has their best-interests in mind, not your own. Insurance companies are trained at finding a reason to deny a claim.

Therefore, if you fill out your no-fault application incorrectly the insurance company may use that to deny needed medical expenses or lost wages for your no-fault claim. In addition to how you fill out your application, the insurance company you work with will try to find information about your well-being in an effort to cut off benefits. Someone at the insurance company may use their gentle tone to ask you if you’re “feeling better” and use your answer against you to deny claims. Unfortunately, this is the way the insurance world works.

Fortunately, we’re here to help. That’s why, it’s important that you contact us as soon as possible if you’ve been injured in a car accident in Rochester so that we can understand what happened and give you the best advice for moving forward.
